Terms and Conditions

General Information

These are the Saddleworth Roundtable terms and conditions of sale and apply to all sales and supplies made by Saddleworth Roundtable to any purchaser.

Prices

The prices shown are inclusive of VAT where appropriate, but exclude carriage charges unless otherwise stated. All orders are accepted on the understanding that goods will be invoiced at the price ruling on the date of dispatch and subject to carriage charges. Saddleworth Roundtable reserves the right to vary its current price list at any time without prior notice. In the unlikely event of an incorrect price being displayed, Saddleworth Roundtable reserves the right to correct the price. In these circumstances the purchaser will not be bound to proceed with that particular purchase and will be asked to confirm that the purchaser wishes to proceed, in writing. Ordering Goods

Saddleworth Roundtable will not supply goods on a sale or return, guaranteed sale, consignment or approval except where agreed with Saddleworth Roundtable in writing in advance. All orders placed on Saddleworth Roundtable are subject to stock availability and only sold on a definite sale and purchase benefit basis. Saddleworth Roundtable will confirm your order by sending an E-mail to you using the address you supplied when registering with our Web site. This E-mail will not bring into existence a legally binding agreement between us. No contract will exist between you and Saddleworth Roundtable until your Debit/Credit Card has been charged. This will be deemed to be our acceptance of your order and to have been effectively communicated to you. Please note that the only language in which the contract can be concluded is in English. Payment

Saddleworth Roundtable accepts payment by most major Credit or Debit Cards. All Credit and Debit Cardholders are subject to validation checks and authorisation by the card issuer. If the card issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery. We may need to contact you by letter, telephone or E-mail to verify details before we are able to dispatch your order. All goods must be paid for in full before they can be shipped to the purchaser, unless otherwise agreed in writing. In cases where Saddleworth Roundtable has agreed credit in writing, the debtors account shall be settled no later than the first day of the month following the date of the invoice. Any accounts unpaid, when due, shall carry interest of 5% per month until paid as well as before and after any judgements obtained in respect of the amount of money outstanding from the purchaser. Delivery All orders are subject to a delivery charge (see ordering section of Web site). Claims of non delivery, whether in whole or in part of any consignment of goods and of any discrepancies between the goods ordered and those supplied and invoiced, must be made by the customer in writing to Saddleworth Roundtable within 7 days of the date of the invoice or other notification of dispatch, whichever shall be the shorter. Failure by the customer to notify Saddleworth Roundtable as aforesaid shall be conclusive evidence that the goods were supplied and delivered in accordance with the contract. Any delivery date stated in the contract is intended as an estimate only and Saddleworth Roundtable shall not be liable for any damage or losses arising out of any delivery otherwise than is so stated. Saddleworth Roundtable will inform you if we become aware of an unexpected delay. Saddleworth Roundtable may delivery the goods in one or more instalments and each instalment may be treated as a separate contract. Failure by Saddleworth Roundtable to make a delivery in whole or in part, in accordance with the contract or any claim by the customer in respect of such delivery or part delivery, shall not entitle the customer to reject the balance of the goods agreed to be purchased by the customer. All goods shall be subject to reasonable commercial variation as to quantity other than where specifically agreed to the contrary by Saddleworth Roundtable in writing. Your order will be delivered by Royal Mail, Royal Mail Recorded Delivery or by Courier. A signature is required for all Royal Mail Recorded Delivery and Courier deliveries. At the request of the customer, Saddleworth Roundtable as agents for the customer, will arrange for carriage and transport insurance to the destination specified in the customers order on such terms as to carriage and insurance as Saddleworth Roundtable consider appropriate, unless the customer specifies otherwise and Saddleworth Roundtable shall invoice the customer of all carriage and insurance costs incurred.

Claim for Damages

Any damage caused to the goods prior to delivery to the purchaser, or for short or mistaken delivery of goods, must be made by the purchaser in writing to Saddleworth Roundtable within 24 hours of the goods being delivered to the purchaser.

Unwanted Goods

If the customer refuses or fails to take delivery of the goods or fails to take any action necessary on his/her part for delivery or shipment of the goods, then Saddleworth Roundtable shall be entitled to terminate the contract with immediate effect, dispose of the goods as Saddleworth Roundtable may determine and recover from the customer any loss and additional costs incurred as a result of such refusal or failure and in any event to retain any payment made prior to such refusal or failure. Goods must be returned in their original and unused condition (including in their original packaging), along with the wrapping and delivery note (as proof of purchase) within 28 days of delivery. Saddleworth Roundtable will exchange it or offer a refund. Where there is no fault found with the goods, Saddleworth Roundtable does not refund delivery charges and may charge for collecting the goods.
This guarantee is in addition to and does not affect your statutory rights.

Faulty Goods

Any goods claimed by the purchaser to be defective and which have been returned to Saddleworth Roundtable carriage paid for by the customer, are found to be defective by Saddleworth Roundtable, the goods will be, without any cost to the purchaser, returned to the manufacturer for repair or replacement by Saddleworth Roundtable at it’s sole discretion, save where expressly agreed in advance or in writing. Saddleworth Roundtable will not be liable to reimburse or compensate the purchaser for the cost of adapting, repairing or replacing the goods, where such adaptations, repair or replacements are due to misuse or mishandling of the goods or materials by the purchaser other than that originally intended.

Reservation of title and transfer of ownership

Property and /or title in the goods ordered by and delivered to the purchaser shall remain vested in Saddleworth Roundtable and all such goods shall be held by the purchaser as bailee for Saddleworth Roundtable, until all monies owed by the purchaser to Saddleworth Roundtable on any account whatsoever have been paid in full. Sales by the purchaser of goods in respect of which property and/or title to such goods has passed to a third party to which the purchaser holds as bailee for Saddleworth Roundtable, shall be made by the purchaser for and on behalf of Saddleworth Roundtable All monies receive by the purchaser in respect of the sale of such goods by the purchaser shall be held by the purchaser as trustee for Saddleworth Roundtable and such monies shall be held separately from any other monies and funds and shall be paid immediately to Saddleworth Roundtable

In the event of failure by the purchaser to pay for the goods within the time specified, Saddleworth Roundtable shall be entitled to require the purchaser to, and the purchaser shall forthwith deliver up the goods to Saddleworth Roundtable at the sole cost and expense of the purchaser. In the purchase of its right, as owner of the goods, Saddleworth Roundtable may repossess any goods the property or title in which has not passed. In such respect the purchaser is hereby deemed to have granted Saddleworth Roundtable license to enter any premises for the purpose of such repossession.

Transfer of risk

Risk in goods transfers to the purchaser immediately upon delivery therefore and not at the same time as property or title in the goods passes to the purchaser. The purchaser shall be solely responsible for insuring the goods immediately upon delivery therefore.

After-sales service and guarantees

Where applicable, details of manufacturer's guarantees or service arrangements will be provided with the product.

Reproduction of colour online is as accurate as photographic and electronic processes will allow.

Liability of Saddleworth Roundtable

No warranties or undertakings or representations are given by Saddleworth Roundtable in respect of the goods other than those contained herein or otherwise imposed by the law.

Saddleworth Roundtable shall not be liable for any statement or expression of opinion by its members or agents of the purchaser with respect to the uses to be made of the goods.

Terms

These terms and conditions shall prevail over any conflicting provision sought to be imposed by a purchaser and supersede any previous terms and conditions previously agreed by Saddleworth Roundtable
